Dowry has been illegal in India for more than sixty years. Yet in many places it still shows up, sometimes openly, sometimes disguised as "gifts" or "what we expect for our son's standing". Every family looking for a match should know where the line is and what to do if someone crosses it.
What the law says
The Dowry Prohibition Act, 1961 makes it a crime to give, take, or ask for dowry. This applies to both families, and also to anyone who helps arrange it. Advertising dowry or offering property in exchange for marriage is also an offence.
Cruelty or harassment of a married woman in connection with dowry demands is a serious criminal offence under India's criminal law, the Bharatiya Nyaya Sanhita. If a woman dies in suspicious circumstances within seven years of marriage and was harassed for dowry, the law treats it as dowry death, one of the most serious offences.
Gifts versus dowry
The law allows voluntary gifts given at the time of marriage, as long as they are not demanded and are reasonable for the family's means. The difference is simple.
| Gift | Dowry |
|---|---|
| Given freely, out of love | Asked for or expected |
| No condition attached | Linked to the marriage going ahead |
| Reasonable for the family | Puts pressure on the family |
Gifts given to the bride, often called stridhan, belong to her. She has full rights over them, even after marriage.
Warning signs during a rishta
- Questions about how much the wedding or the "gifts" will cost before any other conversation.
- Comparisons with what another family gave.
- Hints about a car, flat or cash "for the couple's future".
- Sudden new expectations after the roka.
Any of these is a reason to pause the rishta, however good the match looks on paper.
What to do if dowry is demanded
- Don't agree to it. Paying once rarely ends the demands.
- Keep records. Save messages, call logs and names of people present.
- Talk to your family and a trusted elder.
- Report it. Contact the police on 112, the Women Helpline on 181, or the local Dowry Prohibition Officer. Complaints can also go to the National Commission for Women.
Families can change this
Every family that refuses to give or take dowry makes it easier for the next one. Say clearly, early and kindly that your family does not believe in dowry. The right families will respect you for it.
ShadiGiva does not allow dowry demands on its platform. If anyone asks for dowry or money through the site, please report the profile.
